Default Jack Kirby Heirs Goes After Marvel And The Mouse

The heirs of Jack Kirby, co-creator of Captain America, The Fantastic Four, The X-Men, The Avengers, Iron Man, Hulk, The Silver Surfer and Thor and have sent notices terminating copyright to publishers Marvel and Disney, as well as film studios that have made movies and TV shows based on characters he created or co-created, including Sony, Universal, 20th Century Fox and Paramount Pictures.

Just as the Jerry Siegel estate has done so with rights to Superman, so Kirby's heirs are looking to regain his share of copyright in the characters and their use in comics and other media. the heirs are using the same lawyers as the Siegels, Toberoff & Associates, who have been fairly successful in their case against DC/Warner so far.

Such claims, if found valid, would begin from 2014 and, as always, its worth noting that Marvel/Disney will still own the trademarks of the characters in comics, and the studios in movies. The likelihood is that, if successful, Kirby heirs would enter into negotiation with Marvel over terms to continue publishing comics based on his work.

Jack Kirby battled Marvel for years over the return of the physical artwork to his comics, and was asked to sign documents that would have irrevocable and specifically signed away rights to the characters, something he refused to do. He also contributed to other creators fights with Marvel, including Steve Gerber, co-creating Destroyer Duck with Gerber in a benefit book over the Howard The Duck deal.

Born Jacob Kurtzberg, Jack Kirby is considered the most influential superhero comic artist in the world, though he also worked for decades in romance, war and science-fiction comics. His DC work also provided much of the backbone for the recent blockbuster series Final Crisis from DC. Currently Dynamite, in agreement with the Kirby estate, is working on a new Kirbyverse line, publishing characters that Kirby created independently of Marvel and DC.

He has four surviving children, Susan, Neal, Barbara and Lisa and three grandchildren, Jeremy and Tracy and Jillian.

...Seeing as how the post disappeared, I'll ask this again:

Q: How deep in this is John Morrow, Rich?

    Clockbuster?

Far as typos go, it could have been much worse (and oddly enough, more acurate, heh).
Comics are like a Rorschach test, everyone has a different opinion on what they are and can be.

Default Ok I know that Jack was screwed over ......

...and he deserved to be compensated for his work. HOWEVER, with the exception of a robotic head here at BC. Jack is not with us. Neither is his wife.

This should not turn into "Fuck Marvel" because this is just two companies arguing about money. Jack is not the issue. Nor is Cap or the FF. The issue is money. The likely victims are the fans.

No, but his kids are, and the fact that Kirby couldn't leave millions to his kids did eat at him. Kirby would have approved of this move.

I wouldn't call us victims. It's a problem that I'm sure Marvel knew would come up at some point. Why do you think that dreadful series based on a few sketches from Kirby came out?

The real victims are current Marvel management in some ways. Quesada has tried very hard to make up for the sins of regimes past. But there's some things you just can't resolve without throwing money at it.

Bankrupting Marvel does not benefit anyone.

Disney could very well just write Cap off. He is NO Superman and as the last few years have shown us, Marvel CAN exist without him. I say give Steve to them. Lets see how well they roll with that ball.

YES, the Kirby kids deserve some dough, but not the amounts that will end up being paid to them.

BTW, before I become the "Puppet of the corporations who hates creator rights" MY belief is that the comics industry needs to start paying residuals to character creators. It should be in the standard contract. It is not now. So maybe worried creators can simply "hold back" when working for the majors. You know, like Rob Liefeld did.

Bankrupting Marvel? They just got $4 billion. This won't cover past exploitation, merely future exploitation.
