Local Comic Shop Day On Ebay Already?

Local Comic Shop Day is a promotion arranged by retailer representative group ComicsPRO, for the day after Black Friday. In which participating comic stores have been able to buy exclusive variant versions of all manner of comic books. Participation cost stores $50 or $10 for existing ComcisPRO members to signup to the promotion. And the comics in question were ordered and distributed through Diamond Comic Distributors.

But they failed to make sure only participants got the books. Stores who simply placed an FOC order even if they didn't pay in or sign up to the restrictions, ended up getting the books, and getting them early. And when a few of them sold them on eBay, found themselves challenged by unknown parties.

However, right now, eBay doesn't think that's a valid claim and sellers are free to sell the comics in question. And, it seems, that they are. At least as far as the Avengers #1 variant goes.

Stores selling them include Drewbizz Comics Clothes and More, Nostalgia Ink, Prestige Comics and Comix Zone. Here's the letter received by one comic store from ComicsPRO.

It has come to our attention that you are selling LCSD 2015 ALL NEW ALL DIFFERENT AVENGERS #1 MARQUEZ variant on eBay. This book's on-sale date is specifically set for November 28th, 2015 and is to be sold only by participating Local Comic Shop Day® storefronts.

Please cease and desist selling this book. Since we have no record of you as a participating LCSD storefront, we have alerted Diamond Comics that you are breaking street date. Please be aware that the penalties for breaking street date on our end are possible legal action and a ban on future participation in Local Comic Shop Day®. While we cannot speak to the repercussions from Diamond, selling this item early may result in a loss of Tuesday delivery of your Diamond shipments.

Oh and thorn in ComicsPRO side, Quickstop retailer Dennis Barger who notably didn't sign up to Local Comic Shop Day and who has many grievances with ComicsPRO after being a prominent member at one point, is throwing down the infinity gauntlet on this one.
